By requesting an inspection, scheduling an appointment, submitting a form on our website, or otherwise accessing our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

If you are using the Services on behalf of a business, association, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Description of Services

Community Custom Brick provides residential masonry and construction services, including:

• Inspections and Estimates – On-site property inspections using tools such as moisture meters, thermal imagers, and inspection cameras, followed by written estimates for recommended work.
• Masonry Services – Brick installation and repair, tuckpointing and mortar repair, chimney repair and rebuilds, porch and step repair and rebuilding, stone installation and veneer, glass block installation, retaining walls, patios, walkways, and custom masonry features.
• Scheduling and Communications – Online booking, form submissions, and communications by phone, email, and SMS to coordinate inspections, estimates, and projects.

3. Appointments and Information Accuracy

To schedule an inspection or receive services, you agree to:

• Provide accurate, current, and complete information, including your name, contact information, and property address
• Promptly update us if your contact or property information changes
• Ensure that you are the property owner or are authorized to request work on the property
• Provide reasonable and safe access to the property at scheduled appointment times
• Notify us as early as possible if you need to reschedule or cancel an appointment

We reserve the right to decline or discontinue service where information provided is inaccurate or where these Terms are violated.

4. Payment Terms

Estimates and Project Pricing

Inspections and estimates are provided free of charge unless otherwise stated. Project pricing is set out in the written estimate or contract provided for your specific project. The written contract for your project governs the scope of work, pricing, deposits, and payment schedule.

Financing

Financing options are available through our financing partner, Hearth, which connects homeowners with third-party lenders. Community Custom Brick is not a lender and does not make credit decisions. All financing terms are between you and the lender.

General Payment Terms

• You are responsible for providing valid and current payment information
• Deposits and payment schedules are specified in your written project contract
• Refund and cancellation requests are handled in accordance with your written project contract; please contact us to discuss
• We reserve the right to modify pricing for future work with reasonable advance notice

5. Intellectual Property

All content, materials, and intellectual property associated with the Services – including but not limited to website content, project photographs and videos, designs, documents, logos, and trademarks – are the exclusive property of COMMUNITY CUSTOM BRICK INC or its licensors.

You may not:

• Copy, reproduce, distribute, or create derivative works from our content without prior written permission
• Use our trademarks, logos, or branding without authorization
• Scrape, harvest, or extract data from our website
• Misrepresent our project photographs or materials as your own

6. User Conduct

When using our Services, you agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any portion of the Services or related computer systems
• Interfere with or disrupt the integrity or performance of the Services
• Transmit any viruses, malware, or other harmful code

7. Limitation of Liability

Important: Community Custom Brick provides masonry inspection, repair, and construction services. Inspections and estimates reflect the conditions observable at the time of the visit and are not a guarantee against future damage, deterioration, or concealed conditions.

To the maximum extent permitted by applicable law:

• Community Custom Brick shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services
• Our total liability for any claim arising from the Services shall not exceed the amount you paid to Community Custom Brick for the specific work giving rise to the claim
• Warranties on completed work, where applicable, are set out in your written project contract

8. Disclaimer

The website and online Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Community Custom Brick provides professional assessments and skilled workmanship to help homeowners maintain and improve their properties. However, masonry and construction outcomes depend on numerous factors, including weather, existing structural conditions, and concealed defects that may not be visible during inspection.

You acknowledge that:

• Inspections identify observable conditions and do not guarantee the discovery of all defects
• Estimates are based on conditions known at the time and may be revised if concealed conditions are discovered
• Local permits, codes, and homeowners association requirements vary, and compliance obligations for your property are addressed in your written project contract
• Community Custom Brick does not provide legal or financial advice

9. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms
• Failure to pay amounts due under a project contract
• Conduct that we determine to be harmful to our team, other customers, or Community Custom Brick

You may discontinue use of the Services at any time by contacting us at [email protected]. Cancellation of contracted project work is governed by your written project contract.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of such courts.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
